Polyesters containing bromine and phosphorus are provided by the copolymerization of a ternary system based upon an alcoholic component and an acidic component. The third component is a bromo bisphenol alkyl or aryl phosphine oxide ##STR1## The hydroxyl groups are present in either the para or meta positions, m plus n is from 1 to 8, preferably 1 to 4 and R is an alkyl radical of 1-10 carbon atoms, or an aryl radical of 6-10 carbon atoms. The polyesters which are obtained have flame retardant properties.
