According to an embodiment, a fuel cell includes: a cell staked bodyincluding a plurality of single unit fuel cells stacked one on another; a collecting platelocated on the cell stacked bodyin a stacking direction; an insulating platelocated on the collecting plate; and a tightening structurelocated on the insulating plateand configured to hold the collecting plateand the insulating plateon the cell stacked bodyby being tightened toward the cell stacked body. The tightening structureincludes a first tightening plateincluding a planar portion in surface contact with the insulating plate, and a second tightening platelocated on the first tightening plateand configured to press the first tightening plateagainst the insulating plateby being tightened toward the cell stacked body
