The negative electrode contains a material including at least one of silicon Si and tin Sn as a constituent element. The lithium composite oxide includes lithium Li having a composition ratio a, a first element having a composition ratio b, and a second element having a composition ratio c as a constituent element. The first element including two kinds or more selected from among manganese Mn, nickel Ni, and cobalt Co, and including at least manganese. The second element including at least one kind selected from among aluminum Al, titanium Ti, magnesium Mg, and boron B. The composition ratios a to c satisfy the relationships of 1.1&#x3c;a&#x3c;1.3, 0.7&#x3c;b+c&#x3c;1.1, 0&#x3c;c&#x3c;0.1, and a&#x3e;b+c.

The invention provides a positive electrode material and a battery using the same which can achieve a higher discharge voltage and which can obtain excellent charge-and-discharge properties, without reducing the capacity. A positive electrode () and a negative electrode () are configured through a separator () in between. The positive electrode () contains a compound expressed by a general formula LiMnFePO(wherein x, y and z are values within ranges of 0&#x3c;x&#x3c;0.1, 0.5&#x3c;y&#x3c;0.95, and 0.9&#x3c;y+z&#x2266;1, respectively). According to the compound, the higher discharge voltage can be obtained due to Mn, the Jahn Teller effect of Mncan be attenuated and furthermore distortion of the crystal structure and the reduction of the capacity can be inhibited due to Fe and the excess Li.
